If she will not be able to get F1, what will be her status in USA ?
If she has filed for I-485 then she will be in Adjustment status - allowing her to study, work on EAD and travel overseas on AP. If she hasn't applied for I-485 when her F1 is denied then she will have to come back on H4 - she can study but not work.

A quick question for all you experts out there
My wife is on H4 right now and I am on H1, though we got our EAD last year, but I am still using my H1 and not used my EAD yet, So is it possible to apply for Social Security for my wife, will applying for Social Security Number, considered as using EAD and H1 becomes void.
Use of EAD to get SSN is OK. Don't use EAD for work.

You should not have any problem. Your status is "AOS" which depends purely on unadjudicated 485 applicaion.
You only need AP if you have to travel to US so you will not ahve any problems.
On the practical side though it is *ALWAYS* advisable to have AP ready in case of an emergency.

Anytime your place of work changes on H1, your company should file an amendment to the H1B labor certification stating your new place of work.
Hopefully, the officer at the consulate wont ask and you wont have a problem.
Personally, I have my client's location as well as my company's location on my H1 LCA.

You can file after April 10 (six months to October 10), correct?
Are you planning to get your visa stamped while your are in India? The earliest date to appear for visa stamping is 90 days before the visa start date. I dont know if this rule is very strict or applicable in this case.

Hi,
I am planning to apply my Green card. However I am a bit confused which category will I fall to ? EB2 or EB3 ?
As per my job requirement details, it is as below:
i ) Bachelor degree in technology related field.
In the detailed experience seeked, it says as below:
i) Five years of experience with installing, maintaining servers.
ii) Three years of practical experience in routing and network security.
I have more than 5 years of working experience (which they seeked) before I started this job.
Under which category will it fall under, EB2 or EB3 ?

Guys I am posting this under General Information knowing that this is definitely not an immigration related question. So, please control your urge for giving negative reps. I have booked a wheelchair for my mom who cannot walk properly in Frankfurt airport during her transit of flights. Do they generally take them till the next flight gate? Also, there is only one hour time gap between these 2 flights? Will this be sufficient for them to take her to the next flight gate. Has anyone used this service for your parents and what are their experiences?

Go ahead - there is no problem at all. My parents traveled to Detroit from Bangalore via Frankfurt by Lufth. The had a nice experience - they were taken from one gate to the next by one of those battery operated carts. Everything went smoothly and they did not have to wait much at all (other than the wait during the layover time). Even at Detroit the service was really good - although the guy who got my parents to the exit asked me for tips (which I had ready - but was surprised that he asked for tips - this was the first time someone asked me for tips directly in the US).

My question is regarding Citizenship. My mother married my step father in the year 2000. They have 2 children one is 7 the other is 9. My mother did not adjust her status right after they married. she waited a few years. She received her green card on November of 2006. "the one that renews every 10 years. This year she separated him because she cheated on her. They are not legally separated or anything like that. She wants to become a US Citizen but we think it might be a problem since this year they did not file taxes together. When she did her taxes she checked the box that says shes filing married but separately. He does not want the divorce but she does. I told her she should hold of on any divorce and see about getting her citizenship first. What complications can she have since this year they did not file jointly. I appreciate your time and any input

Issue is getting to Canada and staying there long enough with the high taxes they have average canadian tax burden is 40% (30% tax + 10% additional sales tax on everything you buy) !

It is not illegal. Some companies apply for extensions a bit late and in the mean time, the VISA expires. It is OK. At the most he/she will not be able to drive as the drivers license is linked to the VISA expiry.

1. Came to States on H1B in Jan 2005 thru company A. Worked with company A till July 2005
2. Successfully transferred H1B to company B. Started working with them from July 2005. New I 797 was valid till July 2008. Filed for H1b Ext with company B in Feb 2008.
3. Came to visit India in May 2008 and also to stamp the H1b which was valid till July 2008 thru company B. Got RFE in Indian consulate in Bombay on June 2008 so couldnt travelled back to States.
4. RFE got cleared in Aug 2008 and by that time my H1B expired. Company B received an RFE on H1B extension. They said they cant reply for some reasons and they withdrew the application.
5. In Dec 2008, I filed for H1b extension from company C. Got an RFE to prove the legal status on H1B ext.
Please suggest, what are the chances of getting an approval. I know its little trickier but a straight forward case.
